General Terms and Conditions (GTC)
Scope
The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers domiciled in Switzerland (hereinafter “Customer”).
A consumer is a natural person who has business relations with IT Services Schneeberger that cannot be attributed to their commercial or independent professional activity. Orders for services may be refused at any time without giving reasons.
IT Services Schneeberger reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order is authoritative and cannot be changed unilaterally for that order. Conflicting terms of the Customer or terms deviating from these GTC are not recognised.
The operator of this website is IT Services Schneeberger. Legal notice.
Information on this website
IT Services Schneeberger contains information about products and services. Changes in prices and range as well as technical changes are reserved. All information on www.it-sb.ch (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) serves illustrative purposes, is to be understood as approximate values and is non-binding. In particular, it does not constitute any assurance of characteristics or guarantees unless explicitly stated otherwise. IT Services Schneeberger endeavours to provide all details and information on this website correctly, completely, up to date and clearly, but IT Services Schneeberger cannot warrant this either expressly or tacitly.
All offers on this website are non-binding and are not to be understood as a binding offer.
IT Services Schneeberger cannot guarantee that the listed products are available at the time of the order. All information on availability and delivery times is therefore without guarantee and may change at any time without notice.
Prices
The sales prices stated on IT Services Schneeberger are final prices and, unless stated otherwise, include the statutory value added tax (VAT) and any other statutory charges such as advance recycling fees (ARF) or copyright levies on electronic devices. The prices are strictly net in Swiss francs (CHF).
Any shipping costs are, unless provided otherwise, charged additionally and are to be paid by the Customer. Shipping costs are shown separately in the ordering process.
Technical changes, errors and misprints are reserved; in particular, IT Services Schneeberger may change prices at any time and without prior notice. The sales prices do not include any advisory or support services unless this is explicitly stated in the product description.
Conclusion of the contract
The products and prices on this website are non-binding offers.
By placing an order via this website, including acceptance of these GTC, the Customer submits a legally binding offer to conclude a contract. IT Services Schneeberger then sends an automatic order receipt confirmation by email confirming that the Customer's offer has been received by IT Services Schneeberger. Orders placed are binding for the Customer. Unless stated otherwise, there is no right of return or withdrawal.
The contract is concluded as soon as an order confirmation has been sent by email. By creating a customer account, Customers can also view the status of their order.
Orders are only delivered or performed after full receipt of payment and provided that the goods or services are available. Purchased services are performed as quickly as possible during normal business hours, and appointments are arranged with the Customer as quickly as possible. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, or that services can only be partially performed, IT Services Schneeberger is entitled not to accept or perform the order, or to accept or perform it only in part. In such a case, IT Services Schneeberger will inform the Customer by email. If the Customer's payment has already been received by IT Services Schneeberger, the payment will be refunded to the Customer proportionately. If no payment has yet been made, the Customer is released from the obligation to pay.
Payment options and retention of title
The payment options stated in the ordering process are available to the Customer.
IT Services Schneeberger reserves the right to exclude Customers from individual payment options or to insist on payment in advance without giving reasons.
In the event of late payment by the Customer, IT Services Schneeberger may charge default interest of 5% per annum and a reminder fee of up to CHF 20.- per reminder.
The products delivered to the Customer remain the property of IT Services Schneeberger until full payment has been made. If a service exceeds the time quota booked in advance, the Customer will be informed of this as early as possible, and a corresponding additional payment becomes due in the form of a support package in the web shop.
Delivery, duty to inspect, notice of defects and returns
Deliveries are sent by post or courier service to the address stated by the Customer in the order, or delivered digitally.
IT Services Schneeberger endeavours to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. IT Services Schneeberger is entitled to make partial deliveries. In this case, the Customer is only charged the shipping costs once.
The invoice, insofar as delivery against invoice is offered, is sent by email at the discretion of IT Services Schneeberger.
If the delivery cannot be delivered or the Customer refuses to accept the delivery, IT Services Schneeberger may terminate the contract after notifying the Customer by email and granting a reasonable grace period, and may invoice the costs incurred.
The Customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which IT Services Schneeberger provides a warranty without delay in writing by email to the address in the legal notice.
Returns to IT Services Schneeberger are at the Customer's expense and risk. The Customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects, to the return address specified by IT Services Schneeberger, see legal notice.
If the inspection by IT Services Schneeberger shows that the goods have no detectable defects or that these are not covered by the manufacturer's warranty, IT Services Schneeberger may invoice the Customer for the effort, the return shipment or any disposal.
Right of withdrawal
The Customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. Services are excluded from the right of withdrawal. The deadline is deemed to have been met if the Customer sends the written withdrawal by email or letter (address according to the legal notice, legal notice) to IT Services Schneeberger within the deadline. The withdrawal does not need to be justified.
Exercising the right of withdrawal leads to the reversal of the contract. The Customer must return the goods within 14 calendar days in their original packaging, complete with all accessories and together with the delivery note, to the return address specified by IT Services Schneeberger in the legal notice. Returns to IT Services Schneeberger are at the Customer's expense and risk. Any payment already made will be refunded to the Customer within 30 calendar days, provided that IT Services Schneeberger has already received the goods back or the Customer can provide proof of shipment.
IT Services Schneeberger reserves the right to demand appropriate compensation for damage, excessive wear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice it to the Customer.
No right of withdrawal is granted in the following cases:
- If the contract has an element of chance, in particular because the price is subject to fluctuations over which the provider has no influence;
- If the subject of the contract is a movable item which, due to its nature, is not suitable for return or can spoil quickly;
- If the subject of the contract is a movable item which is made according to the Customer's specifications or is clearly tailored to personal needs;
- If the subject of the contract is digital content and this content is not supplied on a tangible data carrier, or if the contract is to be fully performed immediately by both contracting parties;
- If the subject of the contract is a service and the contract is to be fully performed by the provider with the prior express consent of the Customer before the withdrawal period has expired.
- In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes at the conclusion of the contract to provide the services at a specific time or within a precisely specified period.
Warranty
IT Services Schneeberger endeavours to deliver goods of flawless quality. For defects notified in good time, IT Services Schneeberger assumes the warranty for freedom from defects and functionality of the item purchased by the Customer during the statutory warranty period of generally two years from the date of delivery. It is at the discretion of IT Services Schneeberger to fulfil the warranty by free repair, equivalent replacement or by refunding the purchase price. Further warranty rights are excluded.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the Customer or third parties, or defects attributable to external circumstances. The warranty for consumables and wearing parts (e.g. batteries, rechargeable batteries, etc.) is likewise excluded.
IT Services Schneeberger is not able to give any assurances or guarantees for the timeliness, completeness and correctness of the data or for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of the website does not infringe any rights of third parties that are not owned by IT Services Schneeberger.
Liability
IT Services Schneeberger excludes any liability, regardless of its legal basis, as well as claims for damages against IT Services Schneeberger and against any auxiliary persons and vicarious agents. In particular, IT Services Schneeberger is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the Customer. Any further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.
IT Services Schneeberger uses hyperlinks merely to give the Customer easier access to other web offerings. IT Services Schneeberger can neither know the content of these web offerings in detail nor assume liability or any other responsibility for the content of these websites.
Data protection
IT Services Schneeberger may process and use the data collected in the course of concluding the contract to fulfil the obligations arising from the purchase contract and may use it for marketing purposes. The data required to perform the service may also be passed on to commissioned service partners (logistics partners) or other third parties.
